Privacy Policy

Effective Date: 08/04/2026

1. Introduction

Ten Count Consulting, LLC (“Ten Count,” “we,” “us,” or “our”) respects your privacy and is committed to protecting the personal information we collect through tencountconsulting.com, our consulting services, and our online courses and training programs. This Privacy Policy explains what we collect, how we use and share it, and the choices and rights available to you — whether you're a website visitor, a client, or a learner pursuing continuing education (“CE”) credit.

This policy applies to all individuals who interact with Ten Count, including prospective and current clients, course learners, and website visitors. It does not apply to the practices of third parties we don't control, including the learning management system (LMS) providers and other vendors linked throughout this policy.

2. Information We Collect

  • Complete course registrations, assessments, or evaluations
  • Request or complete CE credit

This information may include:

  • Identity and Contact Information — name, email address, mailing address, phone number

  • Payment Information — billing address and transaction details, processed securely by third-party payment providers (we do not store full payment card numbers)
  • Account Credentials — username and password for learner portal
  • Course Activity Data — registrations, completion status, assessment scores, quiz results, certificates, evaluation responses, and accreditation reporting data where applicable
  • Communications — messages, feedback, and support requests you send us

2.2 Information Collected Automatically

When you use our website or course platforms, we and our service providers automatically collect:

We do not use learner data for unrelated marketing without your consent, and we do not use CE completion data for any purpose beyond administering and reporting that credit.

4. How We Share Your Information

We do not sell your personal information. We disclose information only in the following circumstances:

4.1 Learning Management System Providers

We share data with our LMS providers to administer course registration, learner accounts, completion tracking, assessments, certificates, and related support functions:

LearningCart — processes personal information on our behalf. Policy: learningcart.com/content/Privacy.aspx

Course Container — collects and processes learner data on our behalf, including LMS username, LMS user ID, course status, launches, launch source, and related activity. Policy: coursecontainer.com/content/Privacy-Policy.aspx

4.2 Other Service Providers

  • Payment processors

  • Proposal and contract management tools
  • Analytics, hosting, and IT support providers, which may include Google Analytics or similar tools that use cookies to measure site usage

These providers are contractually required to protect your data and to use it only to perform services on our behalf — not for their own independent purposes.

4.3 Accreditors and Reporting Bodies

If you request CE credit, we may provide required learner data to accrediting bodies to satisfy accreditation, audit, or reporting obligations.

4.4 Legal Reasons and Business Transfers

We may disclose information if required by law, regulation, subpoena, or similar legal process, or to protect the rights, property, or safety of Ten Count, our clients, learners, or others. In connection with a merger, acquisition, or sale of assets, personal information may be transferred as part of that transaction, subject to appropriate privacy protections and, where required, advance notice to affected individuals.

5. Data Retention

We retain personal information for as long as reasonably necessary to:

  • Provide services and support
  • Fulfill course and CE recordkeeping obligations
  • Comply with our legal obligations
  • Resolve disputes and enforce agreements

For CE-related records, retention periods may be longer if required by accrediting bodies or applicable law. When information is no longer needed, we work to delete, destroy, or anonymize it.

6. Cookies and Tracking Technologies

We and our service providers use cookies and similar technologies to:

  • Enable core website and course functionality, including keeping you logged in
  • Understand how visitors use our website and course platforms (analytics)
  • Improve performance, content, and user experience
  • Support marketing measurement, where applicable

You can manage cookie preferences through your browser settings. Disabling certain cookies may affect site functionality. Our systems are not currently configured to respond to browser “Do Not Track” signals.

7. Security Measures

We implement reasonable administrative, technical, and physical safeguards to protect your information, including encryption of data in transit, access controls, and regular security monitoring. No method of transmission or storage is 100% secure, so we cannot guarantee absolute security.

8. Your Privacy Rights and Choices

Depending on your location and applicable law, you may have rights to:

  • Access and portability
  • Correction
  • Deletion, subject to legal and recordkeeping requirements
  • Opt out of non-essential marketing communications
  • Restrict or object to certain processing in some jurisdictions

To exercise these rights, contact us using the information in Section 12. You can also opt out of marketing emails at any time using the unsubscribe link in any message. Opting out of marketing does not affect transactional communications related to your course registration, CE credit, or account.

9. Children's Privacy

Our services are intended for adults and professional users. We do not knowingly collect personal information from children under 13, and if we learn that we have, we will delete it promptly.

10. International Data Transfers

If you access our services from outside the United States, your information may be transferred to and processed in the U.S. and other countries where our service providers operate, which may have different data protection laws than your home jurisdiction.

11. Accessibility

If you use assistive technology and have difficulty accessing this policy or any part of our website or course platforms, contact us using the information below and we will work with you to provide the information in an accessible format.

12. Changes to This Privacy Policy
